Caution
As a result of its investigation of a formal complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Swaida as follows:

•    The treating dentist is required to complete all records contemporaneously to the treatment provided. As a visiting dentist providing treatment with sedation, Dr. Swaida must ensure that all records, and especially sedation records, have been reviewed by him for accuracy and completeness before he leaves the office.

As a result of its investigation of a report, the Inquiries, Complaints and Reports Committee decided to caution Dr. Fadi Swaida as follows: 

•	Dr. Swaida failed to adhere to the Standard of Practice for the “Use of Sedation and General Anesthesia in Dental Practice” by leaving the operatory while patients were sedated and by delegating supervision of patients in recovery to unqualified staff. The Standard of Practice details what constitutes an adequate sedation team because of the need to consistently monitor and, if necessary, respond to, patients’ physiological responses during treatment with sedation. There is always a risk that a patient could become more deeply sedated than intended or expected and require rescue. The management of such incidents may require management of the patient’s airway and/or of cardiovascular complications, and inadequate supervision, whether because there are too few people or improperly trained people present, poses a risk of serious harm or injury, including death. 

•	As a dentist providing sedation services, Dr. Swaida must remain in the operatory whenever a patient is sedated. He may not attend to another patient in another operatory.

•	Dr. Swaida must be diligent about ensuring that he does not delegate to staff what he must do himself or what is beyond the staff members’ training/qualifications. A dental assistant cannot be designated as recovery supervisor for sedation; this is contrary to the requirements set out in the Standard of Practice for the “Use of Sedation and General Anesthesia in Dental Practice” and creates unnecessary and disallowed risks to patient safety. Dr. Swaida must also be present in the operatory when sedation drugs are administered to patients.

• Whether Dr. Swaida works full-time at a practice or is a visiting practitioner on an occasional basis, his professional obligations to his patients do not vary. Dr. Swaida remains responsible for having complete and fulsome informed consent discussions with his patients. Where the proposed treatment is extensive, the informed consent discussion should reflect that higher level of complexity.

• In the event that staff other than Dr. Swaida also engage in informed consent discussions with a patient, Dr. Swaida remains responsible for ensuring that these discussions are accurate and are documented in the patient’s record.

• It is Dr. Swaida’s responsibility to ensure that all portions of the informed consent process are complete and that the patient clearly understands all aspects, ranging from necessity of the treatment, what is involved in the treatment, how many phases are involved in the treatment, the risks of all stages of treatment, treatment alternatives and costs including overall cost and the costs at each stage of treatment.
