As a result of a report, the Inquiries, Complaints and Reports Committee decided to caution Dr. Vicken Takvorian as follows: • Provincial legislation prohibits dentists from engaging in sexual relationships or other forms of affectionate behavior with patients given the inherent power imbalance that exists in this relationship. A patient cannot consent to a sexual relationship with a dentist. Dentists have specialized knowledge and training and are therefore in a position of power and patients may be vulnerable, especially if the dentist is prescribing opioids and sedatives, as in this case. It is therefore incumbent upon the member to establish and maintain appropriate dentist-patient boundaries, as even the most casual dating or social relationship with a patient may result in forms of affectionate behavior that could be defined as sexual abuse. • Dentists who use the Ontario Dental Association’s Recommended Fee Guide are responsible for knowing how to apply the codes and must ensure that the fees and codes they use accurately reflect the services provided. • All prescriptions must be clinically justified as over prescribing or prescribing medication for a non-dental purpose may adversely affect the patient and may erode public confidence in the profession. As a health care practitioner with specialized knowledge and training, the member has a responsibility to ensure that he uses his knowledge and prescribing privileges appropriately.
