As a result of its investigation of a report, the Inquiries, Complaints and Reports Committee decided to caution Dr. Charles Kamel as follows: • Fees cannot be charged and payments cannot be retained for treatment that has not been provided. Where treatment cannot be billed until the treatment has been completed, as is the case for prosthodontic treatment where the prosthesis has not been inserted, Dr. Kamel must return any deposits paid where treatment has not or cannot be completed. • Dr. Kamel cannot charge fees after a patient has died. • Dr. Kamel must ensure that he carries out and carefully documents informed consent discussions with his patients. His documentation of informed consent should be specific to each patient and include discussion of the risks, benefits and alternatives of treatment in each individual case. • Dr. Kamel must disclose adverse outcomes, such as orthodontic treatment that results in an open bite, to patients and/or their parents/guardians. If he does not disclose outcomes of this sort, patients are unable to know about them and about the ensuing risks.
