As a result of its investigation of a formal complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. D'Aloisio as follows: • Dr. D’Aloisio must document treatment plans, treatment options and diagnostic notes with respect to treatment performed. • Dr. D’Alsoiso should have documented the patient’s reaction to the mandibular block in the patient chart notes, in addition to noting that he did not commence treatment until her reaction had stopped. • Sequelae of treatment should be discussed with patients and documented accordingly to manage a patient’s expectations regarding possible outcomes and follow-up care. In this case, Dr. D’Aloisio should have discussed with the patient the likelihood that the restorations would not be successful, and that she would likely require root canal treatment as a result of the clinical condition of her teeth. • Dr. D’Aloisio must obtain informed consent and record informed consent discussions in the patient record. • Dr. D’Aloisio should not place dental instruments or supplies upon a patient’s chest, lap or shoulder/neck area, which is a boundary violation and was explicitly mentioned in the College’s Practice Advisory on the Prevention of Sexual Impropriety in the Dental Office (2003).

As a result of its investigation of a report, the Inquiries, Complaints and Reports Committee decided to caution Dr. Robert D'Aloisio as follows: • Dr. D’Aloisio must comply in all respects with the College’s Guideline on Infection Prevention and Control in the Dental Office, and in particular with respect to proper hand hygiene and glove use. The panel is concerned by Dr. D’Aloisio’s history of breaches of infection control practices, and inadequate hand hygiene in particular, and that the same issues continue to be raised with the College despite courses, monitoring, and cautions provided to him previously. The College has an obligation to protect the public and to ensure all members adequately follow the Guideline on Infection Prevention and Control in the Dental Office. The member is cautioned that the panel believes that his breaches of the Guideline represent a flagrant disregard for public safety. The panel is satisfied in the circumstances, however, with changes to who can be approved as Dr. D’Aloisio’s practice monitor, including that he or she must be a member of a regulated health profession, and feels that this remedy will directly and immediately protect the public.
